No, I'm not saying that at all.  I'm saying that if you don't want to
contribute to the development of Ardour, you satisfy yourself to the
periodic releases.  OTOH if you want the hottest new features and all the
latest code, you contribute to the development in some way - either
technically or financially.  If you and nine of your mates pay $3.50 each
and sort out the distribution yourselves, so be it.  To me, that seems mean
spirited but I can't think of a reason for outlawing it.

That's fine Mark.  There'd be nothing to stop you doing that - but if you
distribute the source to Mr X who later decides he wants SVN updates, then
he'll either have to pay $35 or keep pestering you all the time.
Personally, I think you'd be making a rod for your own back but it's not my
job to prevent you, if that's what you want.
